ISSUING AUTHORITY: John Knoll, City Attorney |
DATE ISSUED: Jan. 5, 2001 |
The Municipal Court Liaison Officer position was abolished effective December 31, 2000, which will require some procedural changes for officers appearing in municipal court.
Witness Coordination
- The city attorney's office will now handle this function.
- Officers with conflicting subpoenas will notify the city attorney's office of the conflict as soon as practical.
- Officers on standby call status must leave a phone or pager number with the municipal prosecutor or intern.
- Ordinarily, the contact person will be municipal prosecutor Todd Love at 368-3883. Please notify Todd if you will be late to court or if you are unable to appear for any reason.
- Officers who do not appear when subpoenaed and who have not been excused will be recommended for disciplinary action pursuant to General Order P01, P08 and P16.
Signing In At Court
- On or off-duty Officers will continue signing in on the "Officer's Daily Court Time Report," but will do so in the courtroom, not in the former liaison's office. If you are attending Court on a day off (R,V, PL,C etc) please make that notation in the status code box on the report.
- The prosecutor will be responsible for getting the "Officer's Daily Court Time Report" into the courtroom so officers can sign in.
- Officers will not fill out "Overtime Reports" or "Compensatory Time Reports." These reports will be prepared by police department staff and forwarded to the officers for signature.
Prisoners brought to Municipal Court
- Municipal judges asked me to advise officers that court business will be conducted in the courtroom, not in the judge's chambers or the former liaison's office.
- If no judge is present in the courtroom, officers should report to the front window and request a judge in the courtroom.
- Prisoners should not be escorted to the former liaison's office or to a judge's chambers.
Requests to Void Citations
- Officers should not ask the city attorney's office to void or dismiss a citation issued by any other officer.
- Officers will be required to follow the ticket abatement procedure set forth in P01.
